Clause 6 in the contract states that the City could drop Mission for cause and only have to purchase the inventory the city had at the time, at used rates.&amp;nbsp; Clause 7 states that if the City lets Mission go without cause, the city has to purchase the inventory and pay a liquidated damages amount.&amp;nbsp; Well, the lawsuit is asking for $4400 inventory and $46000 damages (total of over $51000)&amp;nbsp; I pulled the court papers to read through them, so I could try to see if we had a chance at winning the case.&amp;nbsp; The City Attorney was arguing the fact that the contract is unenforceable because the City Manager isn't authorized to sign contracts, the contract wasn't put out to bid and it didn't go before the council for approval.&amp;nbsp; The judge threw this argument out, which indicates to me that the case is valid.&amp;nbsp; I have been requesting documents to see where we're at:&amp;nbsp; 1.&amp;nbsp; Copy of cancellation letter from Arvin to Mission (doesn't exist)&amp;nbsp; 2.&amp;nbsp; Copy of bid notice where bids were taken for new service (doesn't exist)&amp;nbsp; 3.&amp;nbsp; Copy of Council Agenda were new contract was approved (doesn't exist)&amp;nbsp; 4.&amp;nbsp; Copy of new contract (Sparkle, exists, but was signed by Finance Director, who by the way isn't authorized to sign contracts.&amp;nbsp; Clause 4 in the new contract states that the City doesn't have an existing valid contract with any other company, well--how in the world can you sign this knowing we do???).&amp;nbsp; 5.&amp;nbsp; Amount of fees already charged by the City Attorneys ($13087). It gets even better--Grand Jury report comes out, they met in August 2008 with City Manager, Finance Director and City Clerk regarding bid procedures.&amp;nbsp; Imagine my surprise to find out they totally misrepresented to the Grand Jury!!&amp;nbsp; Ok folks!!&amp;nbsp; My question to you all is simple, is this behavior acceptable to you for our representatives and is it ok with you that once again we are paying for the negligence of others (who by the way contribute NOTHING to our community, they all live outside of Avin)?.&amp;nbsp; Here's my prediction of what is going to happen, especially now that the City knows I'm checking on this:&amp;nbsp; The City is going to settle this matter finally, probably for a little less than what Mission is asking for, say $20000 to $30000. All people regardless of race, religion, color or creed deserve the right to marry whom they please. Please don't make this a religious argument, it boils down to denying rights. There was a point in time when women were denied the right to vote. There was a point in time in the not too distant past when a white person could not marry a black person. There was a point in time when people with disabilities had no rights. Luckily these groups of people had supporters that continued the fight to end such atrocities. I hope there are enough people out there to continue the fight so that gays and lesbians will have the same rights as the rest of the U.S. population.&lt;/P&gt;

&lt;p class="MsoNormal"&gt;To all my friends, this is a long, but very important,
please take time to read it.&lt;/p&gt;

&lt;p class="MsoNormal"&gt;&lt;o:p&gt;&amp;nbsp;&lt;/o:p&gt;&lt;/p&gt;

&lt;p class="MsoNormal"&gt;This
election has me very worried. So many things to consider. About a year ago I
would have voted for Obama.&lt;span&gt;&amp;nbsp; &lt;/span&gt;I have
changed my mind three times since then.&lt;span&gt;&amp;nbsp;
&lt;/span&gt;I watch all the news channels jumpin form one to another. I must say
this drives me crazy.&lt;span&gt;&amp;nbsp; &lt;/span&gt;But I feel if you
view MSNBC, CNN, and FOX news, you might get some middle ground to work
with.&lt;span&gt;&amp;nbsp; &lt;/span&gt;About six months ago, I started
thinking where did the money come form for Obama.&lt;span&gt;&amp;nbsp; &lt;/span&gt;I have four daughters, who went to college,
and we were middle class, and money was tight. We (including my girls) worked
hard and there were lots of student loans.&lt;/p&gt;

&lt;p class="MsoNormal"&gt;&lt;o:p&gt;&amp;nbsp;&lt;/o:p&gt;&lt;/p&gt;

&lt;p class="MsoNormal"&gt;I started
looking into Obama’s life.&lt;/p&gt;

&lt;p class="MsoNormal"&gt;&lt;o:p&gt;&amp;nbsp;&lt;/o:p&gt;&lt;/p&gt;

&lt;p class="MsoNormal"&gt;Around 1979,
Obama started college at Occidental in California.&lt;span&gt;&amp;nbsp; &lt;/span&gt;He is a very open about his two years at Occidental;
he tried all kinds of drugs and was wasting his time but, even though he had a
brilliant mind, did not apply himself to his studies.&lt;span&gt;&amp;nbsp; &lt;/span&gt;‘Barry’ (that was his name he used all his
life) during this time had two roommates, Muhammad Hasan Chandoo and Wahid
Hamid, both from Pakistan.&lt;span&gt;&amp;nbsp; &lt;/span&gt;During the
summer of 1981, after his second year of college, he made a ‘round the world’
trip.&lt;span&gt;&amp;nbsp; &lt;/span&gt;Stopping to see his mother in
Indonesia, next Hyderabad in India, three weeks in Karachi, Pakistan where he
stayed with his roommates family, then off to Africa to visit his father’s
family. My Question – where did he get the money for this trip?&lt;span&gt;&amp;nbsp; &lt;/span&gt;Neither I, nor any one of my children would
have had money for a trip like this when they were in college.&lt;span&gt;&amp;nbsp; &lt;/span&gt;When he came back he started school at
Columbia University in New York.&lt;span&gt;&amp;nbsp; &lt;/span&gt;It is
at this time he wants everyone to call him Barack – not Barry. Do you know what
tuition is at Columbia?&lt;span&gt;&amp;nbsp; &lt;/span&gt;It’s not cheap!&lt;span&gt;&amp;nbsp; &lt;/span&gt;To say the least.&lt;span&gt;&amp;nbsp; &lt;/span&gt;Where did he get the money for tuition?&lt;span&gt;&amp;nbsp; &lt;/span&gt;Student loans? Maybe. After Columbia, he went
to Chicago to work as a Community Organizer for $12,000 a year. Why
Chicago?&lt;span&gt;&amp;nbsp; &lt;/span&gt;Why not New York?&lt;span&gt;&amp;nbsp; &lt;/span&gt;He was already living in New York.&lt;/p&gt;

&lt;p class="MsoNormal"&gt;&lt;o:p&gt;&amp;nbsp;&lt;/o:p&gt;&lt;/p&gt;

&lt;p class="MsoNormal"&gt;By chance he
met Antoin ‘Tony’ Rezko, born in Aleppo Syria, and a real estate developer in
Chicago. Rezko has been convicted of fraud and bribery this year.&lt;span&gt;&amp;nbsp; &lt;/span&gt;Rezko was named ‘Entrepreneur of the decade’
by the Arab-American Business and Professional Association.&lt;span&gt;&amp;nbsp; &lt;/span&gt;About two years later, Obama entered Harvard
Law School.&lt;span&gt;&amp;nbsp; &lt;/span&gt;Do you have any idea what
tuition is for Harvard?&lt;span&gt;&amp;nbsp; &lt;/span&gt;Where did he get
the money for Law School?&lt;span&gt;&amp;nbsp; &lt;/span&gt;More student
loans?&lt;span&gt;&amp;nbsp; &lt;/span&gt;After&lt;span&gt;&amp;nbsp; &lt;/span&gt;Law School, he went back to Chicago.&lt;span&gt;&amp;nbsp; &lt;/span&gt;Rezko offered him a job, which he turned
down, but he did take a job with Davis, Miner, Barnhill &amp;amp; Galland. Guess
what?&lt;span&gt;&amp;nbsp; &lt;/span&gt;They represented ‘Razko’ with Razko’s
firm.&lt;span&gt;&amp;nbsp; &lt;/span&gt;Rezko was one of Obama’s first
major financial contributors when he ran for office in Chicago.&lt;span&gt;&amp;nbsp; &lt;/span&gt;In 2003, Rezko threw an early fundraiser for
Obama which Chicago Tribune reporter David Mendelland claims was instrumental
in providing Obama with seed money for his U.S. Senate race. In 2005, Obama
purchased a new home in Kenwood District of Chicago for $1.65 million (less
than asking price).&lt;span&gt;&amp;nbsp; &lt;/span&gt;With all those
student loans – where did he get the money for property?&lt;span&gt;&amp;nbsp; &lt;/span&gt;On the same day Rezko’s wife, Rita, purchased
the adjoining empty lot for full price. The London Times reported that Nadhmi
Auchi, an Iraqi-born Billionaire loaned Rezko $3.5 million three weeks before
Obama met Nadhmi Auchi many times with Rezko.&lt;/p&gt;

&lt;p class="MsoNormal"&gt;&lt;o:p&gt;&amp;nbsp;&lt;/o:p&gt;&lt;/p&gt;

&lt;p class="MsoNormal"&gt;NOW we have
Obama running for President.&lt;span&gt;&amp;nbsp; &lt;/span&gt;Valerie
Jarrett, was Michele Obama’s boss. She is now Obama’s chief advisor and he does
not make any major decisions without talking to her first.&lt;span&gt;&amp;nbsp; &lt;/span&gt;Where was Jarrett born? Ready for this?
Shiraz, Iran!&lt;span&gt;&amp;nbsp; &lt;/span&gt;Do we see a pattern here?
Or am I going crazy?&lt;/p&gt;

&lt;p class="MsoNormal"&gt;&lt;o:p&gt;&amp;nbsp;&lt;/o:p&gt;&lt;/p&gt;

&lt;p class="MsoNormal"&gt;On May 10,
2008, The Times reported, Robert Malley advisor to Obama was ‘sacked’ after the
press found out he was having regular contacts with ‘Hamas’ which controls Gaza
and is connected with Iran. This past week, buried in the back of the papers,
Iraqi newspapers reported that during Obama’s visit to Iraq, he asked their
leaders to do nothing about the war until after he is elected, and he will
‘Take care of things’.&lt;/p&gt;

&lt;p class="MsoNormal"&gt;&lt;o:p&gt;&amp;nbsp;&lt;/o:p&gt;&lt;/p&gt;

&lt;p class="MsoNormal"&gt;Oh, and by
the way, remember the college roommates that were born in Pakistan?&lt;span&gt;&amp;nbsp; &lt;/span&gt;They are in charge of all those small
Internet campaign contribution for Obama.&lt;span&gt;&amp;nbsp;
&lt;/span&gt;Where is the money coming from?&lt;span&gt;&amp;nbsp;
&lt;/span&gt;The poor&lt;span&gt;&amp;nbsp; &lt;/span&gt;middle class in this
country? Or could it be from the Middle East?&lt;/p&gt;

&lt;p class="MsoNormal"&gt;&lt;o:p&gt;&amp;nbsp;&lt;/o:p&gt;&lt;/p&gt;

&lt;p class="MsoNormal"&gt;And the
final bit of news. On September 7, 2008, The Washington Times posted a verbal
slip that was made on ‘This Week’ with George Stephanapoulos. Obama was talking
about his religion said, ‘My Muslim faith”. When questioned, he made a
mistake.&lt;span&gt;&amp;nbsp; &lt;/span&gt;Some mistake!&lt;/p&gt;

&lt;p class="MsoNormal"&gt;&lt;o:p&gt;&amp;nbsp;&lt;/o:p&gt;&lt;/p&gt;

&lt;p class="MsoNormal"&gt;All of the
above information I got online.&lt;span&gt;&amp;nbsp; &lt;/span&gt;If you

Gov. Arnold says in the "yes" ads that it will add billions of dollars over the next 20 years or so. "No" ads say that this is selling the state short because the Indian tribes will not be paying their fair share (or something). &lt;/P&gt;
&lt;P&gt;On principal, I don't care for sin taxes. They tamper with free choice, they&amp;nbsp;usually follow someone else's moral or religious agenda, and I've never heard of sin taxes solving financial&amp;nbsp;shortages. The tobacco tax, for example, was meant to educate school kids about the dangers of smoking. Never happened; the&amp;nbsp;tax money went to the general fund, and still does as far as I know. Lottery funds were supposed to supplement our underfunded schools.&amp;nbsp;Schools are still underfunded and the new state budget will cut school funding even more. &lt;/P&gt;
&lt;P&gt;With our ailing economy, higher unemployment and the coming recession, I doubt&amp;nbsp;mobs of people will be rushing to Indian casinos to play slots. The revenue to produce billions of dollars is not going to be there--not in the near future, anyway. &lt;/P&gt;
&lt;P&gt;But I'm voting&amp;nbsp;"yes" because I haven't heard of Indians taking issue. I assume it's o.k. with them. Who am I to stand in the way of free enterprise. illegal immigrants. The muddled logic goes something like this: &lt;br&gt;

Illegal immigrants do menial jobs Americans won't do. Farmers need this
ready labor force to harvest fruit and produce in an economical and
timely manner. The nice farmer and supermarket chains pass the savings
on to us when we go food shopping. &lt;br&gt;

Of the 12 million or so illegals in this country about 2% or less work
in jobs related to agriculture. Their kids get a free education, they

accept an low wage and work conditions Americans won't.&lt;br&gt;

As to "cheap" farm produce at the market--cheaper than what? If you
haven't food-shopped lately, ask someone who has. Prices have been
raised to an exploitive degree, anyway.&amp;nbsp; &lt;br&gt;
&lt;br&gt;
Whatever the feelings or issues of illegal immigration, please do not
use the cheap labor argument or how it helps the economy, or that
illegal immigrants fill jobs that us lazy Americans simply won't do.
There is no factual basis for that argument. &lt;br&gt;

Imigrents, and so forth. &lt;/P&gt;
&lt;P&gt;Here is my take on it.&amp;nbsp; &lt;/P&gt;
&lt;P&gt;1) This is a free country and all can pray to whom they like or nobody at all. But that does not mean we change our country and laws&amp;nbsp;in order not to upset a group.&amp;nbsp; This country was built on values that are based in a belief in God does not say what God only God. The ten commandments were voted as part of our value system. To have different Groups come in and want to change&amp;nbsp;things that this country was founded in is wrong. No one is telling them how to pray or worship. This country needs to get back to what it was founded on. All are welcomed but not to get here and want to change this country to be like the one they came from. &lt;/P&gt;
&lt;P&gt;2)&amp;nbsp;The pledge of allegance is being questioned come on . If they dont believe in this country leave it.&lt;/P&gt;
&lt;P&gt;3) To many special groups are changing to many core values in this country. Then you want to know why the prisons are to full. Why gangs are out of control. We need to stop all the garbage.&amp;nbsp; I could say that the blue uniforms the police wear scares me to much so they should change. Everyone is allowed to believe how they like but this country does not have to keep changing to cater to these groups. IF THEY WANT TO CHANGE THE COUNTRY MOTTO OR THE BELIEFS THIS COUNTRY WAS FOUNDED ON THEN PUT IT UP TO A NATIONAL VOTE ON EACH ISSUE.&amp;nbsp; This country was founded in God. It allows everyone to believe how they want. But they should not have the right to change this country. Morals in this country have dropped because of many of the changes. &lt;/P&gt;
&lt;P&gt;4) The only people realy gaining here are the lawyers taking these issues to court. They dont care of the issue just the money and fame. &lt;P&gt;Typical example. Candidates in line for a debate. Each smiles, poses, and gives stock, generic answers to questions. Like watching a beauty contest.&lt;/P&gt;
&lt;P&gt;Hillary walks on stage and asks, "Are you ready for change?" Audience responds with frenzied screams and applause like a rock concert. Then Hillary proceeds to say nothing.&lt;/P&gt;
&lt;P&gt;Obama has raised the most money--now there's a qualification if I ever heard one. Jesse Ventura won his election with a shoestring budget. Could it have been because Gov. Ventura said something that got the voters attention? &lt;/P&gt;
&lt;P&gt;Fred Thompson entered the race after thinking about it for some time. And then broke the suspense by announcing his hat in the ring on a late night comedy talk show. How many stayed up till midnight just to hear Fred's answer. I didn't. &lt;/P&gt;
&lt;P&gt;I could go on, but I think you get the gist. Theatrics and network news polls do not tell me what the candidate is about. &lt;/P&gt;
&lt;P&gt;I'm just wondering. regularly. Here's something I learned by happenstance on a local radio
station, not the usual news outlets--which makes me suspicious of our
current administration:&lt;br&gt;
&lt;br&gt;
Effective Sept. 1, the Labor Day weekend, trucks from Mexico will no
longer be required to drive over the border in a 25 mile "buffer zone"
and transfer their cargo to American trucks and warehouses (which will
put alot of Teamsters out of work). Trucks from Mexico will be allowed
to deliver their cargo anywhere in the US on our highways. The Dept. of
Transportation (or whatever the dept.) says the trucks coming from
Mexico "will comply with our guidelines" as far as safety regulations
are concerned. Cargo in the trucks will be inspected and permitted to
cross the border and go their merry way as long as the cargo is a
Mexican export made in Mexico. I don't know what "our guidelines" is
supposed to mean. That apparently is not anybody's business.&amp;nbsp; The
Mexican truck driver is not required to read or speak English. I assume
the drivers are familiar with our traffic laws and safety regulations
or have some sort of certification to drive a truck on state and
interstate highways, that was not qualified either. Oh, and those log
books truck drivers are required to keep--well, Mexican truck drivers
are not required to do that for a year. I guess after a year, somebody
will crack down. As to insurance, well, he'll have Mexican insurance--I
mean, insurance is insurance, isn't it? So, let's not nit-pick. &lt;br&gt;
&lt;br&gt;
The Teamsters are trying to get an injunction on Mexican trucks,
arguing among other things, the safety hazards of big rigs from Mexico,
in the 9th Circut Court. Which is in San Francisco and like trying a
murder case in front of a Los Angeles jury. Talk about strange
bedfellows, the Sierra Club is on board with the Teamsters, arguing the
lack of pollution control on Mexican trucks and the high pollutant
diesel, which sells for about 87cents in Mexico. To circumvent our
outrageous fuel prices, Mexican trucks will have extra fuel tanks
filled with Mexican diesel--which does not conform to clean air
standards and will make one heck of a bomb if the truck crashes and
burns.&lt;br&gt;
&lt;br&gt;
Now as dismal as this sounds, there is a good side to it all. NAFTA, as
we children who don't understand the complexities of trade have been
told,&amp;nbsp; is good for the country. It makes consumer prices cheaper,
creates jobs, and we should be happyabout that.&amp;nbsp; At least that's
what the corporations who have outsourced jobs have said--and the
President.&lt;br&gt;
&lt;br&gt;
I won't be on the highway over Labor Day weekend. But if I happen to
see a truck with a Mexican license plate, I'm going to give it some
distance. &lt;br&gt;
