With all the 'other' agencies investigating..I'm curious to see EXACTLY how many charges and persons are involved..are you guys going to stand in line to try to retrive some of your monies?I just hope they don't try this case in our courts--with ALL of the re-trials we have had lately..we'll go broke..lets not confuse the D.A.'s office any further...by the way,WHY wern't they looking into this in the first place?

It's unclear how many charges will be filed, if any. The assistant U.S. Attorney says each charge carries a maximum of 20 or 30 years, depending on type. But it's a complex rubric, in which the dollar amount of the crime and criminal history are factored into how much time a person serves. And sometimes, a plea bargain is reached. Again, that's if there's any evidence of criminal wrongdoing.

As for the money, I 'm told ad money owed to KGET 17 was not backed by a personal guarantee. And Crisp & Cole and Associates was a corporation. It's essentially a shell at this point now that the two have split up, and neither one is perosnally responsible for the money, again since there was no personal signature guarantee.

The reason why the Californian and 29 The Eyewitness News Station can go after Crisp and Cole personally is because they personally guaranteed the loans. Both of those lawsuits go back for a hearing next month.

The financial cases will go before a Kern County judge and be tried by personal lawyers, since it's a civil case.

The criminal case (again, IF one is filed) will go before a federal judge.

As for the Kern County DA stepping into the criminal side...I refer you to the script of a story Jim Scott aired on August 22:

17 news has learned there are no cases of mortgage fraud being prosecuted right now.

In fact, a spokesman for the district attorney's office says he can't remember a single case coming across his desk in the last five years.
"That doesn't mean we're not going to get one," said Supervising Deputy District Attorney Steve Katz, a supervisor in the White Collar Crime Unit. "We've had a couple of reports on one or two items and we've referred those individuals to federal authorities or the state department of real estate for investigation of those claims."

Keep it up Kiyoshi. This story is a long ways from being over. I am interested to know if Crisp has consulted with and/or hired any attorneys yet. He'll not only need a civil attorney, a criminal attorney but probably a bankruptcy attorney as well. Wonder if he stashed some of the money he made off all the refinancings and "seconds" he took out on some of his property since his assets may eventually be frozen!
