Vincent Brothers Trial

Domestic Violence Issue 5/17/07

The judge will allow Brothers' ex-wife Shann Kern to talk about a prior act of domestic violence in 1988 by the defendant.  It was a misdemeanor charge.  The defense will be allowed to argue it was expunged.

In their arguments:

J Anthony Bryan: "It was a very mild incident.  It’s a very common offense in every community.  And it was disposed of by way of dismissal."

Green: "I hope that we never reach that day when we view domestic violence as a common occurrence in our community."

Couple who live next door had loud argument and he threw food at her & she threw dishes at him. No cops called; nobody really concerned; not the first show they put on for the neighbors. (Couple doesn't have kids & I hope they never do.)  Point is, "domestic violence" is a broad term, though not a pleasant one. Is the jury really going to dwell on an incident that happened so long ago?

Interesting how the prosecution bashed defense witnesses by saying that they had no business more or less testifying about a man they had not seen in 20 years.  Yet her witness testified about an incident that occurred nearly 20 years ago as well.  Simply an observation, but does that make sense to anyone?
But yes, Lisa Green's case was obviously more compelling that that of the defense.  I mean obviously she had hurdles and it was an uphill battle otherwise the arrest would have come so much sooner than it had, right?
But sometimes it is not so easy to prove your innocence.

Yes, Lisa Green openly admits she had an uphill battle.  And she said the greatest hurdle was trying to explain how she thinks a father and husband could murder his family.

As I figure it, there are several ways to look at the evidence and testimony Tuesday:

1. People are people.  They don't change.  A guy who was genuine and nice 20 years ago, is still genuine and nice today.  That is, he's incapable of committing this crime.

2. Despite what friends and family knew about him 20 years ago, Brothers is a much different, more sinister man today.   Or, as the prosecutor says, Brothers is a psychopath who has two sides that aren't readily apparent to everyone he meets.
